Terms and Conditions

1. scope of application


These General Terms and Conditions (GTC) apply to all services, subscriptions and offers of Zapsell GmbH (“Zapsell”, “we”, “us”) via the zapsell.ch website and all associated communication channels. By using our website or our services, you agree to these GTC.

2. benefits


Zapsell provides services in the areas of web development, SaaS development, WordPress customization, hosting and ongoing support on a subscription basis. The specific scope of services depends on the individual offer or the subscription plan booked.

3. subscription and payment

  • Services are provided on a monthly subscription basis.

  • Prices and included services are listed on our website or in the individual offer.

  • Payment is due at the beginning of each billing period, unless otherwise agreed.

  • All prices are in Swiss francs (CHF) including VAT, unless expressly stated otherwise.

4 Obligations of the customer

  • The customer shall provide all necessary information, content and access required for the provision of the service.

  • The customer is responsible for the accuracy and legality of all content provided.

  • The use of our services for unlawful or unauthorized purposes is prohibited.

5. right of withdrawal (only for consumers under Swiss law)

  • Consumers have the right to withdraw from the contract within 14 days without giving any reason. The period begins on the day the contract is concluded.

  • A clear declaration (e.g. by e-mail) to us is sufficient to exercise the right of withdrawal.

  • If you request that we start providing the service before the end of the withdrawal period, your right of withdrawal expires as soon as the service has been provided in full.

6 Copyright and rights of use

  • Pre-existing tools, frameworks or third-party components remain the property of the respective rights holders.

  • Zapsell may present completed projects in its portfolio unless the customer expressly objects to this in writing.

7. support and maintenance

  • Ongoing support and updates are included in the respective subscription.

  • Support is provided during regular business hours by e-mail, WhatsApp or contact form.

  • Emergency support or additional services may be charged separately.

8. force majeure


We are not liable for delays or non-performance caused by events beyond our control (e.g. natural disasters, power failures, internet service outages, strikes).

9. liability

  • Zapsell is only liable for damage caused by gross negligence or intent.

  • Liability for indirect damages, loss of profit or loss of data is excluded.

  • The maximum liability is limited to the amount that the customer has paid to Zapsell in the last 12 months before the damage occurred.

10. data protection


Personal data is processed in accordance with our privacy policy.

11. language


In the event of translations, the German version of these GTC shall prevail.

12. final provisions

  • Swiss law shall apply exclusively. The place of jurisdiction is Zurich, Switzerland.

  • Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.

  • We reserve the right to amend these GTC at any time. Significant changes will be announced on our website.
